3. Acceptance of these terms
By using our website, booking a consultation, or using our Services, you agree to these terms. If you do not agree, please do not use the Services. Where you click to accept or submit a form, that electronic acceptance forms a binding agreement, and electronic records of it are valid and admissible under the Evidence Act 2011.
4. Who can use our Services
You must be at least 18 years old and able to enter into a contract. If you are acting for someone else, you confirm you have their authority to share their information with us.
5. What we do, and what we do not promise
We provide honest guidance and practical help. For study and relocation, we help strengthen your application and guide you through the process. For visas, we explain requirements, help you prepare your documents, and tell you plainly where your case is strong and where it is weak. For flights, we consult with you and work to find the most affordable fares, then help you book and remind you before you travel.
We do not guarantee outcomes. Visa approvals, scholarship and admission decisions, and final flight prices and availability are decided by third parties such as embassies, universities, and airlines, and are outside our control. We promise effort, honesty, and a clear process. We do not promise that any application will be approved or that any specific price will be available. Any statement we make about your chances is our honest opinion, not a guarantee.
6. Consultations, fees, and payments
Your first consultation is free. If any of our Services carry a fee, we will tell you the full amount and what it covers before you pay, with no hidden charges. Prices are in Naira unless we state otherwise, and we may add VAT or other statutory charges where they apply. Where you pay for a service, payment is arranged through a legitimate, CBN-licensed channel that we agree with you. We do not collect or store your full card details through this website.
7. Third-party services
Where we help you book flights, insurance, accommodation, courses, or appointments, those products and services are provided by third parties under their own terms and prices. We act to help you, but we are not responsible for the acts, decisions, fees, or service failures of those third parties. Please read their terms before you commit.
8. Your responsibilities
You agree to give us accurate and complete information, to provide genuine documents, and not to ask us to take part in anything false, misleading, or unlawful, including submitting false information to any embassy, school, or airline. Giving false information can harm your application and may end our engagement.
9. Acceptable use of the website
You agree not to misuse the website, including by attempting to gain unauthorised access, disrupting the site, scraping data, submitting spam or malicious content, or using it for any unlawful purpose. We may suspend access where we reasonably suspect misuse.
10. Intellectual property
The website, its content, brand, and design belong to us or our licensors. You may use the site for your own personal, non-commercial use. You may not copy, reproduce, or reuse our content without our permission.
11. Privacy
We handle your personal data in line with our Privacy Policy and the Nigeria Data Protection Act 2023. Please read the Privacy Policy to understand what we collect and why. By using the Services you acknowledge that policy.
12. Fraud and security
We take fraud seriously. Attempting to defraud us, our clients, or any third party through the website may be reported to the authorities under the Cybercrimes (Prohibition, Prevention, etc.) Act 2015, as amended.
13. Disclaimers and limit of our responsibility
We provide the Services with reasonable care and skill. To the extent the law allows, we are not liable for indirect or unforeseeable losses, or for losses caused by third parties such as embassies, airlines, or universities, or by your giving us inaccurate information.
Nothing in these terms limits or excludes any liability that cannot be limited or excluded under Nigerian law. This includes your rights under the Federal Competition and Consumer Protection Act 2018, and liability for fraud or for death or personal injury caused by our negligence. Your statutory consumer rights are preserved and are not affected by these terms.
14. Indemnity
You agree to cover us for reasonable losses we suffer because you breached these terms or misused the Services, including by giving false information.
15. Suspension and ending our engagement
Either of us may end an engagement by letting the other know. We may suspend or end Services where you breach these terms, ask us to act dishonestly, or where continuing would put us in breach of the law.
16. Events outside our control
We are not responsible for delays or failures caused by events beyond our reasonable control, such as embassy or airline disruptions, strikes, natural events, or changes in law or policy.
17. Complaints and disputes
If you are unhappy, contact us first at hello@japafirst.ng and we will try to resolve it quickly and fairly. If we cannot resolve it, a consumer complaint may be taken to the Federal Competition and Consumer Protection Commission (FCCPC), and a data protection complaint to the Nigeria Data Protection Commission (NDPC). Otherwise disputes will be resolved by good-faith negotiation, and failing that, by the courts of Nigeria.
18. Governing law
These terms are governed by the laws of the Federal Republic of Nigeria, and the Nigerian courts have jurisdiction.
19. Changes to these terms
We may update these terms from time to time. The current version will always be on this page with its effective date. Continuing to use the Services after a change means you accept the updated terms.
20. General
If any part of these terms is found invalid, the rest still applies. If we do not enforce a right immediately, we can still enforce it later. You may not transfer your rights under these terms without our consent. These terms, with the Privacy Policy, are the whole agreement between us about the Services.
